Welcome to Binom AI. These Terms of Service (“Terms“) govern your access to and use of the platform, synthetic AI employees (agents), and services provided by BINOM AI, Inc. (“Binom AI“, “we“, “us“, or “our“) via binomai.com and app.binomai.com (collectively, the “Service“).
By registering for an account, accessing, or using the Service, you (“Customer“, “User“, or “you“) agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
Binom AI operates an AI agent marketplace and management platform providing autonomous digital solutions (“synthetic employees”) for business roles, including Sales, Support, HR, Recruiting, Marketing, SMM, Legal Assistance, and other commercial workflows.
You may use the Service strictly for lawful commercial purposes in accordance with these Terms. You are solely responsible for:
Prohibited Activities: You agree not to use the Service for any unlawful activities, unauthorized data scraping, reverse engineering, API abuse, distribution of malware or illegal content, or attempts to access unauthorized accounts or data.
No Automated Legal Effects: Binom AI provides AI-assisted decision-support tools. We do not make automated decisions producing legal or similarly significant effects on individuals (under Art. 22 GDPR) without human involvement. Ultimate decision-making power (e.g., hiring, contractual decisions) remains exclusively with the Customer.
EU AI Act Compliance & Transparency: If you utilize AI agents for use cases classified as high-risk under the EU AI Act (e.g., recruitment and HR management under Annex III), you act as the deployer of the AI system and carry sole responsibility for informing affected individuals and maintaining human oversight. You are responsible for ensuring that End Users are notified when interacting with an automated AI system (Art. 50 EU AI Act).
The Service supports optional integrations with third-party platforms, including Google Services (YouTube, Google Drive, Docs, Sheets), Meta Platforms (Facebook, Instagram), CRM systems, and messaging protocols via OAuth and APIs.
By enabling third-party integrations, you agree to comply with the terms of service and policies of the respective third-party providers, including but not limited to:
Binom AI is not responsible for the availability, restrictions, operational changes, or service disruptions caused by third-party platforms.

Where you upload or transmit personal data of End Users through the Service, you act as the Data Controller and Binom AI acts as the Data Processor, operating strictly under your instructions and applicable Data Processing Agreements (DPA).
To the maximum extent permitted by law, BINOM AI, Inc., its directors, employees, or partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of profits, revenue, data, or operational downtime arising out of or in connection with your use or inability to use the Service or third-party integrations.
We reserve the right to update these Terms periodically to reflect platform enhancements or changes in regulatory requirements. Continued use of the Service following the posting of updated Terms constitutes your acceptance of those changes.
